Terms of Use
These Terms are the free-app public statement for Yak. A full consumer/billing EULA (refunds, EU 14-day withdrawal) will replace or supplement this page before any paid features ship. Counsel sign-off remains recommended before commercial EU-scale launch.
1. Agreement
These Terms of Use (“Terms”) govern your use of the Yak podcast player app and related public pages at yakplayer.com (together, the “Service”), published by TGC Network LLC (“we”, “us”). By downloading, installing, or using Yak, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy (https://yakplayer.com/privacy) explains how data is handled and is separate from these Terms. Do not treat the Privacy Policy as a substitute for these Terms.
2. The free service (v1)
Yak’s first public release is free. It is a local-first podcast player: subscribe to feeds, download and play episodes, manage a queue, and export/import backups on your device.
Not included in free v1: in-app purchases, subscriptions, paid Cloud sync hosted by us, premium upsells, or ads in the app. If we offer paid features later, updated terms (including refund and EU withdrawal language) will apply before billing is enabled.
3. Eligibility
The Service is not directed at children under 13. You must be old enough to form a binding contract in your jurisdiction, or have a parent/guardian’s permission. See also our Privacy Policy § Children’s privacy and Play target-audience declarations.
4. Third-party podcast content
Podcast feeds, episode audio, artwork, show notes, and related media are provided by independent publishers and hosts, not by TGC Network LLC. You choose which feeds to subscribe to (including arbitrary RSS/Atom URLs and directory results).
- We do not control, endorse, or guarantee third-party content, availability, or legality.
- Publishers may change or remove content; feeds may include material you find offensive or inaccurate.
- Your use of third-party content is also subject to those publishers’ and hosts’ terms and policies.
- Discovery may use Podcast Index, Apple iTunes Search, and (only if you opt in) gpodder.net — each under their own terms.
You are responsible for complying with applicable law when accessing and storing media on your device.
5. Acceptable use
You agree not to:
- Misuse the Service to harm others, distribute malware, or violate law
- Attempt to disrupt our website, discovery proxy, or related infrastructure
- Scrape or bulk-exfiltrate directory data in ways that violate Podcast Index, Apple, or other provider terms
- Misrepresent affiliation with Yak or TGC Network LLC
- Use the Service to infringe intellectual property or privacy rights of others
We may refuse support or take reasonable technical steps if misuse threatens the Service or other users.
6. User reports and hidden content
Yak lets you hide shows or episodes on your device and optionally email a report to support@yakplayer.com. Hide lists stay on-device. We only receive a report if you send the email. Reports do not guarantee removal from the public internet; we are not the host of third-party podcast media.
7. Intellectual property
Yak the app, brand, and yakplayer.com site content (excluding third-party podcast media) are owned by TGC Network LLC or its licensors. Open-source components are listed in the app under Settings → About → Open-source licenses and remain under their respective licenses.
If you believe content accessible through Yak infringes your rights, contact support@yakplayer.com with enough detail to identify the material and your claim. For third-party hosted media, you may also need to contact the publisher or host directly.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that third-party feeds will remain available.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TGC NETWORK LLC AND ITS OFFICERS, DIRECTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR THIRD-PARTY CONTENT. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE FREE SERVICE WILL NOT EXCEED USD $50 OR THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
10. Indemnity
You will defend and indemnify TGC Network LLC against claims arising from your misuse of the Service, your violation of these Terms, or your use of third-party podcast content, except to the extent caused by our willful misconduct.
11. Changes
We may update these Terms from time to time. The effective date at the top will change. Continued use after posting constitutes acceptance of the updated Terms for free-app use. Material changes before paid features ship will be reflected here and, where required, in a billing EULA.
12. Governing law
These Terms are governed by the laws of the United States and the State of formation of TGC Network LLC, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your country of residence may still apply. Courts in that jurisdiction may hear disputes, subject to those mandatory rights.
